Students and their families have important rights in the suspension context, including adequate notice and due process rights that schools are legally obligated to uphold. ELC creates two new tools to help “eligible students” (students who are 18+ or students who are attending a post-secondary institution) and parents to ensure that a student’s school has complied with all legal duties required by state and federal law, spot potential rights violations in the suspension context, and make requests for suspensions to be expunged (removed) from a student’s education record when their rights were violated. Seeking expungement is important as colleges, post-secondary programs, and employers may ask about suspensions contained in a student’s education record.
- Suspension Expungement Request (Parents): Parents, guardians, people acting in the place of a parent/guardian, and educational decision-makers can use this tool to request suspension expungement on a student’s behalf.
- Suspension Expungement Request (Eligible Students): “Eligible students” who are 18 years or older or are attending a postsecondary institution can use this tool to request suspension expungement on their own behalf.
