This analysis explains the critical role of diversity, equity and inclusion (“DEI”) policies and practices in addressing and remedying racial discrimination under Title VI, and squarely addresses assertions in federal guidance and executive orders claiming that DEI is prohibited by federal law or was rendered unconstitutional by the U.S. Supreme Court’s ruling in Students for Fair Admissions, Inc. v. President & Fellows of Harvard Coll., 600 U.S. 181 (2023) (“SFFA”).
